Today, bylaws are solely intended to define HOA governance. Other documents are used for rules and regulations, architectural change, owner responsibilities, and so on.
While the HOA documented the fact that owners are responsible for chimney caps and maintaining modified porches there was no specificity to the work being done by qualified individuals.
I get the impression that your development has been around since the later years of the 20th century with no real interest in making HOA governance up to current standards. Consequently, I would recommend that you gather up all the governing documents and take them to an attorney familiar with South Carolina HOA law (SC HOA Attorneys) as well as national standards. Consider contacting the South Carolina chapter of Community Associations Institute for guidance; Webpage: CAI - SC .
An owner who is part of the regime can definitely sue the regime. Liability is an issue. However, just because someone falls off a ladder, does not automatically make the association responsible or liable. Sometimes it is just the person's fault.
I suggest you consult with your insurance agent to make sure you have adequate coverage for these situations. That conversation may answer a lot of your questions, and it doesn't cost anything to ask.
hopefully he tied a safety line around him in case the ladder decides it has had enough of him on it and goes over -- I have to laugh seeing this at a place where the person did tie a rope around their waist for a saftey line but the end of the rope was dangle on the ground --
3041oceaninc: 40 units condo. Floors 3-7 units have the same SF. However floor 4-7 have balconies with size 130 SF, floor 3 has terrace size 1,400SF. Common charges are based on SF of the unit and there is absolutely nothing extra for units with terrace. Correct?

maperk1234: I recently started a facebook page so owners of the condo can communicate. The management company would not send the list of names, so I put flyers under doors to alert owner/occupants about the group and options to join. I am being fined for flyers! 2K!
